Sexual Abuse & Molestation Prevention Policy

Policy effective: 2025  |  Applies to all employees, volunteers, and independent contractors  |  Review annually

1. Purpose & Scope

CodePoint Capital LLC d/b/a Hoop Vision ("Hoop Vision") is committed to providing a safe, respectful, and supportive environment for all participants, with special emphasis on the protection of minors. This policy applies to all employees, volunteers, coaches, instructors, officials, and independent contractors ("Staff") who have any contact with program participants.

This policy is required by our insurance carrier and reflects our organization's zero-tolerance stance on any form of sexual abuse, exploitation, or grooming behavior involving minors.

2. Prohibition of Grooming Behaviors

Hoop Vision strictly prohibits all grooming behaviors. Grooming is defined as any conduct — verbal, physical, electronic, or otherwise — intended to gain the trust of a minor or their family for the purpose of facilitating abuse. Prohibited behaviors include but are not limited to:

  • Giving a minor gifts, money, or special privileges not available to other participants
  • Communicating with a minor outside of official program channels (including text, DM, social media, email, phone) without parental knowledge and consent
  • Seeking one-on-one contact with a minor in unsupervised or private settings
  • Discussing sexual topics, sharing sexual content, or making comments of a sexual nature with or around minors
  • Touching a minor in any manner not required by legitimate coaching or first-aid activities
  • Taking photographs or videos of minors outside of official program activities without parental consent
  • Showing favoritism to a specific minor in a manner that isolates them from peers
Social Media & Outside Contact Policy Staff are prohibited from initiating or accepting social media connections, direct messages, or personal contact with any minor participant outside of official Hoop Vision communications. Any necessary communication with a minor must include a parent/guardian in the correspondence.

3. Supervision & Two-Adult Rule

Hoop Vision enforces a Two-Adult Rule: no Staff member shall be alone with a minor participant without a second adult present or in direct visual contact. This applies to:

  • Practice sessions, games, and training activities
  • Transportation arranged by Hoop Vision
  • Any meeting or counseling session
  • Locker rooms and changing areas (Staff are prohibited from being present while minors change unless a safety emergency requires it)

All activities will be conducted in open, observable spaces to the greatest extent possible.

4. Background Checks

Hoop Vision requires criminal background checks for all employees, volunteers, and independent contractors prior to any contact with minor participants. Background checks must include:

  • National sex offender registry search
  • County and federal criminal history check
  • Identity verification

Any individual with a conviction for a crime involving violence, sexual misconduct, child abuse, or exploitation will not be permitted to participate as Staff in any capacity. Background checks must be renewed at minimum every two (2) years.

5. Staff Training & Awareness

All Staff members with access to children must complete documented sexual abuse awareness training before beginning work with participants. Training must cover:

  • Defining sexual abuse and grooming
  • Recognizing warning signs of grooming and abuse
  • Mandatory reporting obligations under applicable state law
  • Hoop Vision's reporting procedures
  • Proper boundaries between Staff and participants

Training completion must be documented in writing with the Staff member's signature and date. Records are retained on file and available for review by the organization's insurance carrier upon request.

Hiring managers are additionally trained to identify high-risk behaviors and responses during the interview and hiring process.

6. Employment & Volunteer Screening

All employment, volunteer, and independent contractor applications must include, in addition to criminal history disclosure:

  • Disclosure of any prior allegations or investigations involving child safety or sexual misconduct
  • Disclosure of any prior terminations or resignations related to child safety concerns
  • Three professional references, at least one from a supervisor in a role involving work with minors

Any false or incomplete disclosure is grounds for immediate disqualification or termination.

7. Reporting Procedures

All Staff, participants, and parents are encouraged to report concerns. Reports will be taken seriously, investigated promptly, and kept confidential to the extent permitted by law.

Step 1 — Immediate Safety: If a child is in immediate danger, call 911.

Step 2 — Do Not Investigate Alone: Staff who observe or receive a disclosure of suspected abuse must not attempt to investigate on their own. Do not confront the alleged abuser directly.

Step 3 — Report Internally: Report the concern immediately to the Program Director or organizational leadership (dev@codepointcapital.com). If the concern involves the Program Director, report directly to organizational leadership or the board.

Step 4 — Mandatory Reporting: Hoop Vision Staff are mandatory reporters. Any reasonable suspicion of child abuse or neglect must be reported to the appropriate state child protective services agency or law enforcement. Staff shall not delay or withhold a report pending internal investigation.

Step 5 — Preserve Information: Document what was observed or disclosed in writing as soon as possible. Preserve any physical evidence and do not alter the environment of an alleged incident.

Step 6 — Administrative Leave: Any Staff member under investigation for abuse or grooming will be placed on immediate administrative leave pending the outcome of the investigation.

Reports may also be submitted anonymously. No retaliation will be taken against any person who makes a good-faith report of suspected abuse.

8. Policy Communication & Compliance

This policy will be:

  • Provided in writing to all Staff before they begin working with participants
  • Posted on the Hoop Vision website
  • Reviewed and signed annually by all active Staff members
  • Updated as needed to reflect changes in applicable law or best practices

Any Staff member who violates this policy is subject to immediate disciplinary action up to and including termination and referral to law enforcement.

By signing below, I confirm that I have received, read, and understand the Hoop Vision Sexual Abuse & Molestation Prevention Policy. I agree to comply with all provisions of this policy and understand that violations may result in immediate termination and/or legal consequences.
